Counsel for Eastern Cape Judge President Selby Mbenenge has taken issue with a witness failing to produce evidence that Judges’ Secretary Andiswa Mengo forwarded her a picture of the top Judge’s alleged private parts.
The counsel says the picture includes the alleged image of the judge’s private parts, which Mbenenge denies.
The top Judge’s counsel, Advocate Griffiths Madonsela, put his concerns to the witness, Judges’ Secretary Ntomboxolo Jobela, who testified that she no longer had the phone that received the picture of the alleged private parts.
Madonsela: “Now, it is concerning to me that you have not produced the screenshot of the screenshot of the conversation that was sent to you.”
Jobela: “I don’t even have that phone that I used back then.”
Madonsela: “And that is precisely the problem.”
