Days after he received R80 000 bail from the Mthatha magistrates Court in a case involving millions of Rands allegedly fraudulently claimed as medico-legal costs from the EC Dept of Health, attorney Zuko Nonxuba is alleged to have attempted to syphon more millions from the department.
When the Special Investigations Unit (SIU) got wind of his instruction to the sheriff of the court for them to institute summons for two other claims amounting to R40m, the SIU acted swiftly and in collaboration with the Dept of Health an urgent interdict was launched to prevent the payments from being made.
“The Head of the Special Investigating Unit (SIU) welcomes the order handed on the 5th March 2019 in the High Court in Mthatha. As a result of this High Court order, SIU and the Eastern Cape Provincial Department of Health managed to interdict and stop two payments of R26 000 000 and R13 000 000 to an attorney from Nonxuba Inc. Attorneys who was recently arrested and charged with fraudulent medico- legal claims to the value exceeding R90 000 000”, read a statement from the SIU.
Nonxuba’s arrest followed an intensive investigation by the SIU and the Eastern Cape Department of Health. The investigation revealed a number of fraudulent medico-legal claims. SIU, the Hawks and National Prosecuting Authority (NPA) collaborated and ensured that the attorney was arrested.
Nonxuba was released on R80 000 bail. Following his release he allegedly called the Sheriff in Centurion Gauteng demanding payments of R26 000 000 and R13 000 000. This was brought to the attention of the Head of SIU, Adv Andy Mothibi who swiftly instructed the SIU legal team to work with the Eastern Cape Department of Health and the Gauteng Sheriff to initiate a legal process to stop these further payments.
“The investigation into fraudulent medico-legal claims is ongoing and based on the evidence gathered thus far, we expect more arrests in due course”, said Adv Mothibi
Adv Mothibi has congratulated the SIU Investigating Team, The Eastern Cape Provincial Department of Health Team, The Gauteng Centurion Sheriff Team for working hard around the clock to ensure that evidence is placed before the High Court to obtain interdict and stop these further payments.
He stated further that, it is through this collaboration by law enforcement agencies, NPA, State Institutions and members of the public that the state will succeed to clamp down on the fraudulent and corrupt practices, holding those responsible to account and ultimately protecting the interest of the public.
