The Mbabane High Court in eSwatini has dismissed the state’s application to declare the Ndimande brothers’ late appeal against their extradition order invalid.

Siyabonga and Malusi Ndimande were arrested earlier this year at a rented house in Mbabane for their alleged involvement in the murder of rapper Kiernan “AKA” Forbes and his chef friend, Tebello Motsoane, in Durban, in February last year.

Their defence team is opposing the extradition order to bring them back to South Africa, which was granted by the Manzini Magistrate’s Court in August.

The court ruled that the appeal was filed within the specified time frame.

The case has been postponed for the submission of the appeal grounds from the defence after which the next court sitting will be determined.
